What happens to my children if I die without a Will?
If you die without a legally valid Will appointing guardians, you do not get to decide who looks after your children.
Under the Children Act 1989, responsibility for deciding who should care for a child falls to the courts. In practice, this process often involves local authority (social services) while suitable arrangements are considered.
Social services may:
- Carry out welfare checks
- Assess family members or others who could care for your children
- Make recommendations to the court based on the child’s best interests
Until a decision is made, your children may be placed into emergency foster care to ensure they are safe.
This does not mean social services automatically take permanent control — but it does mean:
- Decisions are no longer yours
